Refund and Cancellation Policy

Please read carefully before making any payment. By purchasing or subscribing to any XetaBytes product or service you confirm you have read, understood, and accepted this policy.

Overview

At XetaBytes we design and deliver digital services, products, and subscription-based solutions with care and professional commitment. Because of the digital nature of many of our offerings and the time, resources, and custom work invested by our team, all services, digital products, subscriptions, and related purchases provided by XetaBytes are non-refundable, non-exchangeable, and non-negotiable. We ask that you review product descriptions, scope of work, pricing, and terms thoroughly before making a payment.

Scope — What this covers

This policy applies to (but is not limited to):

  • One-time services (campaigns, creative services, consulting hours, audits)
  • Ongoing services and retainers (social media management, performance marketing, PR)
  • Digital products (templates, courses, downloadable assets, training recordings)
  • SaaS features, subscription plans, add-ons, credits and account upgrades/downgrades
  • Event tickets, workshop registrations, and any custom deliverables ordered through XetaBytes

Our Core Policy

  1. No refunds. Once payment is completed for any product or service, we do not issue refunds.
  2. No exchanges. Paid products and services cannot be traded for other products, services, or cash equivalents.
  3. Non-negotiable. Terms of sale, pricing and refund decisions are final, except where mandatory consumer protection law requires otherwise.
  4. We state this clearly so you can make an informed decision before you pay.

Subscriptions, Billing & Cancellation

  1. Auto-renewals: Subscriptions renew automatically at the end of each billing cycle unless cancelled prior to the next renewal date.
  2. Cancelling a subscription: You may cancel at any time to prevent future charges. Cancellation will stop future billing, but any fees already paid for the current billing period are non-refundable.
  3. Downgrades & upgrades: Changes to plan levels will take effect according to our billing rules; fees already paid remain non-refundable.
  4. Tip: To avoid unwanted charges, please cancel at least 48 hours before the scheduled renewal date.

Digital Deliverables & Access

  1. Immediate access: Once a digital product or access link is delivered, it is considered consumed — refunds are not available.
  2. Course access / recordings: Access fees, recordings, and downloadable materials are non-refundable once access is granted.
  3. Licenses & downloads: Licenses sold are final; replacement or exchange for other licenses does not apply.

Cancellation of Services

  1. If a client requests cancellation before work has commenced, we may accept the cancellation, but any fees already paid are retained by XetaBytes and are not refundable.
  2. Where we have incurred third-party costs on your behalf (tools, ad spends, contractor fees), those costs will be deducted or retained in full.

Service Delivery Concerns and Support

  1. We want every client to feel confident in working with us. If you believe a product or service was not delivered as promised:
  2. Please contact our support team (details below) within 7 days of delivery.
  3. Provide order details, screenshots, or other relevant proof.
  4. We will investigate and where appropriate offer remediation such as rework, additional support, or a service credit at our discretion. Service credits are not the same as refunds.

Chargebacks, Fraud & Abuse

Initiating a chargeback or a payment dispute with your bank without first contacting us may lead to service suspension, account restrictions, and further administrative action. If you think there has been unauthorized activity or a payment error, please contact us immediately so we can resolve it together.

Exceptions and Legal Requirements

Q: I’m not satisfied — can I get my money back?

This Refund & Cancellation Policy (the “Policy”) governs all transactions, purchases, subscriptions and services provided by XetaBytes. Except where a mandatory provision of applicable law requires otherwise, this Policy supersedes and controls over any inconsistent oral, electronic, or written statements, representations, or pre-contractual discussions. No amendment or modification of this Policy will be effective unless made in writing and expressly signed by an authorized officer of XetaBytes.

Q: Can I cancel a service and get a prorated refund?

Refunds, charge reversals, or other monetary remedies will be considered only in the limited circumstances listed below and then only at XetaBytes’ sole and absolute discretion:

  • Proven duplicate payment or demonstrable payment processor error confirmed by both the payment provider and XetaBytes;
  • Confirmed and documented unauthorized transaction or identity fraud where the claimant provides full cooperation and all requested documentation; or
  • A material, written breach by XetaBytes of a signed Service Agreement that XetaBytes fails to cure within a commercially reasonable period after receiving written notice and an opportunity to cure.
  • All other requests for refunds, prorations, exchanges, or similar relief are expressly excluded.

Q: What if a service was never delivered?

Prior to initiating any formal legal proceeding, arbitration, or regulatory complaint, the customer must:

(a) provide XetaBytes with written notice of the dispute in the manner set out above; and (b) allow XetaBytes a mandatory six (6) month period from receipt of such notice (the “Mandatory Resolution Period”) to investigate, propose, and implement remedial measures, which may include re-performance, technical correction, additional services, or service credits. During the Mandatory Resolution Period the parties shall reasonably cooperate and meet (in person or virtually) as requested by XetaBytes to seek a good-faith resolution. No legal action, filing, or chargeback shall be commenced or pursued by the customer during this Mandatory Resolution Period, except to the extent a court of competent jurisdiction determines that immediate equitable relief is necessary to avoid irreparable harm; even then the customer must first notify XetaBytes and provide reasonable opportunity to seek injunctive relief from a competent forum. Failure to comply with this Mandatory Resolution Period shall constitute a waiver of the customer’s right to seek monetary relief in any court or through arbitration (to the fullest extent permitted by law) and will entitle XetaBytes to seek dismissal, sanctions, or recovery of its fees and costs.

Remedies — XetaBytes’ Sole Discretion

If XetaBytes elects to provide a remedy following a timely and validated claim, XetaBytes’ preferred remedies are limited to (i) correction or re-performance of the deficient services, (ii) non-transferable service credit(s) applicable to future XetaBytes offerings, or (iii) a refund only where refund is legally mandated or expressly approved in writing by an authorized XetaBytes representative. Service credits or remedial services are final and not exchangeable for cash unless required by law.

Chargebacks, Payment Disputes & Administrative Recovery

Customers must not initiate chargebacks, payment reversals, or unilateral disputes with their bank, card issuer, or payment provider without first providing written notice to XetaBytes and permitting the Mandatory Resolution Period to elapse. Initiating a chargeback in violation of this Policy may result in immediate suspension of services, account restrictions, denial of access to deliverables, and recovery actions for administrative fees, advisory costs, and collection expenses (including attorneys’ fees). XetaBytes reserves the right to offset any contested amount against available service credits or outstanding receivables.

Limitation of Liability & No Consequential Damages.

To the fullest extent permitted by applicable law, XetaBytes’ aggregate liability arising under or in connection with this Policy or any purchase shall be limited to the amount actually paid by the customer for the specific product or service at issue. XetaBytes shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including, without limitation, lost profits or loss of business, even if XetaBytes has been advised of the possibility of such damages.

Indemnity & Customer Representations

The customer expressly agrees to indemnify, defend, and hold harmless XetaBytes and its officers, directors, employees and agents from and against any third-party claims, liabilities, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of the customer’s breach of this Policy, fraudulent or abusive use of services, misrepresentations, or failure to follow the mandatory claims procedure.

Dispute Resolution; Governing Law; Forum Selection; Class Action Waiver

This Policy and any disputes related to it shall be governed by the substantive laws of India without regard to conflict-of-law rules. Except as set forth below, any dispute, controversy or claim arising out of or relating to this Policy shall, at XetaBytes’ option, be resolved exclusively either (a) in the courts of competent jurisdiction located in Noida, Uttar Pradesh, India, or (b) by final and binding arbitration seated in Noida, India pursuant to the Arbitration and Conciliation Act, 1996 (or any successor law). Arbitration or litigation may be commenced only after the Mandatory Resolution Period has expired and the parties have complied with the claims procedure in this Policy. To the fullest extent permitted by law, customers waive the right to participate in class, collective, or representative actions.

Enforcement Remedies for Non-Compliance

If a customer initiates litigation, arbitration, or a chargeback in breach of the Mandatory Resolution Period or other procedural requirements of this Policy, XetaBytes shall be entitled to seek all available remedies, including dismissal, sanctions, recovery of attorneys’ fees, and any other costs incurred in defending or responding to such improper action. XetaBytes’ rights and remedies under this Policy are cumulative and in addition to any other rights or remedies available at law or in equity.

Severability Interpretation

If any provision of this Policy is found by a tribunal of competent jurisdiction to be invalid, illegal or unenforceable, that provision shall be reformed only to the extent necessary to make it enforceable and the remaining provisions shall continue in full force and effect. XetaBytes’ reasonable interpretation of any ambiguous term shall control.

Mandatory Legal Review and Local Law Exceptions

While drafted to protect XetaBytes’ legitimate business interests, certain provisions of this Section (including but not limited to mandatory waiting periods, waivers, and forum-selection clauses) may be restricted or rendered unenforceable by applicable consumer protection laws in certain jurisdictions. Accordingly, XetaBytes recommends that this Policy be reviewed by qualified legal counsel prior to use in markets where enforceability may vary. To the extent any mandatory statutory consumer rights apply, XetaBytes will comply with such rights but will limit remedies to the minimum required by law.

Changes to this Policy

XetaBytes may update this policy from time to time. When we do, we will post the revised version on our website with an updated “Effective date.” Your continued use of our services after the effective date constitutes acceptance of the updated policy. Always check the policy before making a purchase.

Acknowledgement and Acceptance

By making a payment or subscribing to XetaBytes, you acknowledge that you have read and understood this Refund & Cancellation Policy and accept that fees paid are non-refundable, non-exchangeable, and non-negotiable unless required otherwise by law.
